The U.S. Capitol Police announced on Thursday that they had decided not to press charges against two men who filmed themselves engaging in sexual acts within a Senate hearing room.
This decision came after a thorough review of the incident, which involved a video of the men having anal sex in the Hart Senate Office Building’s hearing room. The police statement clarified that, despite the actions likely violating congressional policy, no evidence suggested a crime had been committed.
“For now, we are closing the investigation into the facts and circumstances surrounding a sex video that was recorded inside the Hart Senate Office Building on the morning of Wednesday, December 13. After consulting with federal and local prosecutors, as well as doing a comprehensive investigation and review of possible charges, it was determined that – despite a likely violation of Congressional policy – there is currently no evidence that a crime was committed,” U.S. Capitol Police said.
The incident involved a congressional staffer who had access to the room, which was not open to the public at the time. Despite the lack of cooperation from the two individuals involved, the inability for the incident to meet the elements of any possible crimes compelled the investigation to be concluded.
The staffer in question exercised his Fifth Amendment rights and chose not to speak to investigators, who remain open to reviewing new evidence if it emerges.
“The Congressional staffer, who has since resigned from his job, exercised his Fifth Amendment right to remain silent and refused to talk to us. Our investigators are willing to review new evidence should any come to light,” the police continued.
Leaked footage of the sex act taking place in a Senate hearing room first surfaced last December. The footage showed a naked congressional staffer in a compromising position on a table typically used by senators during hearings. This room was identified as Hart 216, known as the Judiciary Room. The video’s leak was confirmed to have occurred in a private chat group for gay men involved in politics.
