In the most recent blow to United States President Joe Biden’s push to force all Americans to be vaccinated, The Daily Wire reports that on Monday, another federal court denied the Department of Justice’s request for a stay of the temporary block on vaccine mandates for healthcare workers.
Missouri Attorney General Eric Schmitt said in a statement Monday morning: “The 8th Circuit Court of Appeals denied the Department of Justice’s motion for a stay pending appeal in our lawsuit against the vaccine mandate on healthcare workers, meaning our injunction will stay in place.”
Schmitt added: “This is a huge victory for healthcare workers in Missouri and across the country, including rural hospitals who were facing near-certain collapse due to this mandate. While today’s ruling is a victory, there’s more work to be done, and I will keep fighting to push back on this unprecedented federal overreach.”
On Dec. 2, following two preliminary injunctions placed by federal courts in Missouri and Lousiana on the healthcare worker vaccine mandate, the Department of Health and Human Services’ Centers for Medicare & Medicaid Services announced they were suspending enforcement of the mandate pending review.
A Centers for Medicare and Medicaid Services Memo stated:
“The Centers for Medicare & Medicaid Services (CMS) will not enforce the new rule regarding vaccination of health care workers or requirements for policies and procedures in certified Medicare/Medicaid providers and suppliers (including nursing facilities, hospitals, dialysis facilities and all other provider types covered by the rule) while there are court-ordered injunctions in place prohibiting enforcement of this provision.
While the CMS remains confident in its authority to protect the health and safety of patients in facilities certified by the Medicare and Medicaid programs, it has suspended activities related to the implementation and enforcement of this rule pending future developments in the litigation.
Accordingly, while these preliminary injunctions are in effect, surveyors must not survey providers for compliance with the requirements of the Interim Final Rule.”
With Monday’s ruling denying the Justice Department’s request for a stay on the injunction, it appears CMS will continue to suspend implementation and enforcement of the vaccine mandate.
Meanwhile, CNBC reported that Pfizer’s CEO Albert Bourla said that he believes a fourth booster shot may soon be needed, and on Sunday, Biden Administration medical spokesperson Dr. Anthony Fauci told Americans that boosters may be deemed necessary and if so, we will “just have to deal with it.”
