A federal judge has ruled against a signature Democrat-pushed bill that allows illegal immigrants to stay in America.
The Deferred Action for Childhood Arrivals amnesty plan (DACA) has been blocked by a federal judge — the decision will likely be appealed and ultimately decided by the U.S. Supreme Court.
Former President Barack Obama implemented the controversial policy by memo in 2012. The program allows children of illegal immigrants to stay in the country and obtain work permits.
U.S. District Judge Andrew Hanen issued the ruling. Blaze News Media reported that Hanen had previously ruled the DACA program unconstitutional, but due to a technicality, he was required to reissue his decision.
Judge Hanen wrote: “While sympathetic to the predicament of DACA recipients and their families, this Court has expressed its concerns about the legality of the program for some time.”
The judge added: “The solution for these deficiencies lies with the legislature, not the executive or judicial branches. Congress, for any number of reasons, has decided not to pass DACA-like legislation.”
DACA opponents claim Obama overstepped his authority in authorizing the program and argue that only Congress can pass a law establishing amnesty.
Hanen’s ruling prohibits Biden administration officials from granting amnesty to additional applicants but allows the program to continue for the approximately 578,000 who have already been processed and received DACA amnesty.
Many prominent Democrats oppose the ruling. Rep. Pramila Jayapal (D-WA) said: “Unfortunately, this decision is no surprise from Judge Hanen. This is completely unacceptable. Dreamers deserve better and the fight is not over.”
