Indiana AG Vows Investigation Into Doctor Who Gave 10-Year-Old Girl Abortion: ‘We’re Going to Fight This to the End’

The physician who has been a central part of the now-national story about a 10-year-old rape victim could become part of an investigation into her own practice.

Dr. Caitlyn Bernard, an OB/GYN and pro-abortion activist, admitted to multiple news outlets that she was the one who performed an abortion on a 10-year-old girl from Ohio after being contacted by a child abuse doctor in the state.

Bernard alleges that the child was six weeks and three days pregnant, but could not get an abortion in her home state after the overturning of Roe v. Wade.

The truth of the story, however, was thrown into doubt, as no one had independently corroborated the story, despite its publication in several major media outlets, and it being mentioned in a speech by President Joe Biden. Ohio Attorney General Dave Yost (R) said this week that his office had heard “not a whisper anywhere” about the victim or the perpetrator.

On Tuesday, however, the story was proven to be true, when a 27-year old Illegal Immigrant, Gershon Fuentes, confessed to sexually assaulting a child on at least two occasions. He was arrested and charged with rape.

Now, Indiana Attorney General Todd Rokita has told Fox News’ Jesse Watters that he intends to investigate Bernard for her failure to report the case to law enforcement. Indiana has a mandatory reporting law which requires any person who suspects child abuse to report the incident to law enforcement. 

“We have this abortion activist acting as a doctor with a history of failing to report,” Rokita said. “So, we’re gathering the evidence as we speak, and we’re going to fight this to the end, including looking at [Bernard’s] licensure if she failed to report. In Indiana it’s a crime to intentionally not report.”

“This is a child, and there’s a strong public interest in understanding if someone under the age of 16 or under the age of 18 or really any woman is having an abortion in our state,” he continued. “And then if a child is being sexually abused, of course parents need to know, authorities need to know, public policy experts need to know. We all need to know as citizens in a free republic so we can stop this.”

Rotika then put Bernard and the media on blast for having “politicized” the tragic story “for the gain of killing more babies.” 

“They were right there jumping in on all this, thinking that it was gonna be great for their abortionist movement when this girl has been so brutalized,” Rotika said.

Bernard released a statement on Twitter Wednesday after news of Fuentes’ arrest broke. “My heart breaks for all survivors of sexual assault and abuse. I am so sad that our country is failing them when they need us most,” Bernard said. “Doctors must be able to give people the medical care they need, when and where they need it.”

Bernard’s statement would suggest that in Ohio, which has a 6-week abortion ban, that anyone outside of that ban is completely out of luck. However, Tiana Lowe, writer with the Washington Examiner, contests that Ohio Law would have provided an exception in this case allowing the child to receive an abortion in Ohio. She says, “According to Detective Jeffrey Huhn, the Ohio girl at the heart of this tragedy did indeed obtain a medical abortion, meaning she was likely no more than nine weeks pregnant, in Indianapolis, as Bernard initially claimed. But although Ohio’s heartbeat law restricts almost all abortions, including in cases of rape or incest, after six weeks of gestation, the law makes exceptions for pregnancies that pose a ‘serious risk of the substantial and irreversible impairment of a major bodily function’ to the mother.”

“State Attorney General Dave Yost confirmed that this exception applied to the girl in question, which makes obvious sense,” she continued. “Even if a girl gets her first period at 10 or younger, she likely has not developed a pelvis capable of safely carrying a pregnancy to term, let alone delivering a live baby. Although most conservatives may disagree with Ohio’s six-week abortion ban failing to include a rape and incest exception, just about nobody of note in the pro-life movement would ever favor denying an abortion when a pregnancy seriously imperils the life and physical health of the mother.”
