President Joe Biden’s press secretary Wednesday called the Supreme Court’s overturning Roe v. Wade, which legalized abortion, an unconstitutional action.
“[T]here has been an urgency from this President from day one when the Supreme Court made this extreme decision to take away a constitutional right,” said White House press secretary Karine Jean-Pierre. “It was an unconstitutional action by them — a right that was around for almost 50 years, a right that women had to make a decision on their bodies and how they want to start their families.”
Justice Samuel Alito delivered the Supreme Court’s 5-4 majority opinion in the Mississippi case of Dobbs v. Jackson Women’s Health Organization on June 24. It overturned the 1973 decision in Roe v. Wade and the 1992 Casey v. Planned Parenthood case that had legalized abortion, with some restrictions.
Abortion rights activists became enraged after the nation’s highest court ruled abortion was something each state would have to decide because it was not in the U.S. Constitution. Protestors began converging outside the suburban homes of justices and chasing them from public places like restaurants.
One California man, telling police he was so distraught over the court’s views on gun rights and abortion, flew to Maryland with a gun and ammo in order to kill Justice Brett Kavanaugh in his Maryland home.
Many Democrats have suggested or began actions designed to counter the previously perceived right to an abortion upon demand. The Biden administration’s Justice Department has thrown its weight around to blunt the rush of red states to ban abortions, going so far as suing the state of Idaho over their abortion ban.
Claiming the Supreme Court — which by definition determines what is constitutional — committed an unconstitutional act by issuing an unfavorable ruling sent the twitterati twitching.
“This woman may be the dumbest press secretary ever employed by a White House,” tweeted talk radio host Erick Erickson, “and I remember Scott McClellan.”
Senator Josh Hawley’s (R-MO) press secretary Abigail Marone was flabbergasted by Jean-Pierre’s remarks.
“It honestly feels cruel to put her on the podium and make her answer questions each day,” she commented in a Wednesday Twitter post.
“She is not the first self-appointed tenth justice but may be the first White House Press Secretary to make such Article III judgments,” remarked George Washington University Law Professor Jonathan Turley.
