A Virginia Democratic politician Susanne Gibson solicited funds online by performing sexual acts on video with her spouse. This act might have contravened Virginia’s prostitution regulations, according to two state attorneys who spoke with The Daily Wire.
The Virginia law states that “any person who, for money or its equivalent … engages in sexual intercourse” or other sexual acts with another person “is guilty of prostitution, which is punishable as a Class 1 misdemeanor.”
“The statute is very clear, you cannot for money or its equivalent perform sex acts,” Shawn M. Cline, a former prosecutor and defense attorney in Virginia Beach, remarked. “It doesn’t matter who’s paying for the act, if it’s an observer or the recipient. You can’t receive money.”
“It would definitely be a chargeable offense,” Cline said.
“Y’all can watch me pee if you tip me and some tokens,” Gibson can be heard saying in the graphic videos. “Again, I’m raising money for a good cause.”
ScrofanoLaw, a law firm that defends Virginians accused of sex crimes, highlights that Virginia is stringent in prosecuting prostitution offenses. The definition of prostitution, according to § 18.2-346 of the Virginia Law Code, encompasses anyone who, in exchange for money or its equivalent, agrees to engage in sexual acts.
Gretchen Taylor Pousson, formerly a public defender in Virginia and currently a defense attorney with ScrofanoLaw, believes Gibson breached the statute. She stated that the tokens Gibson received are equivalent to money, and Gibson performed these acts on another individual.
Gibson also discussed a scheme in a video where she would deceive hotel staff into seeing her undressed without their consent, aiming to provide a sexual thrill for herself and her viewers.
“Tell him I want a bottle and have them bring it into the room and we’ll be naked and they can all watch. It’s gonna be great. I’m definitely a slut,” she said. “In order to leave the door cracked I need 500 tokens from 10 of y’all. 10. Otherwise not worth it. Don’t get me kicked out from my favorite hotel y’all.”
Pousson suggested that such actions could breach statutes related to indecent exposure. This statute pertains to someone who intentionally displays themselves obscenely in a public place or where others are present.
“I think it would be. It would all depend on how the court determines a ‘place where others are present,’ but given that she caused them to come in, I think that could easily be argued by the Commonwealth,” Pousson told The Daily Wire.
Henrico County Commonwealth’s Attorney Shannon L. Taylor, a fellow Democrat like Gibson, did not respond when asked if her office was contemplating charges against Gibson.
The videos Gibson streamed on Chaturbate were broadcasted in September 2022, shortly after she initiated her Senate campaign. The last video on that platform was uploaded on September 30, which means the statute of limitations would lapse in two weeks.
Despite the exposure of her video endeavors by The Washington Post, The Daily Wire, and other media outlets, Gibson remains in the race. L. Louis Lucas, the leader of the Virginia Senate and a Democrat, asserted that Gibson’s actions were all the more reason to financially support her. He baselessly accused Gov. Glenn Youngkin of involvement.
Several Democrats claimed that the scandal was inconsequential because, in their view, Gibson’s actions did not breach any criminal boundaries.
Gibson labeled the act of uploading the videos she herself made available to the public as “an illegal invasion of my privacy.”
The New York Times described the situation as a “leak,” even though media outlets merely informed their readers about Gibson’s actions without linking to the videos.
Gibson uploaded her videos to a platform where she amassed over 5,700 followers. She expressed her desire for a vast audience in the videos, stating, “And I love that they’re all watching me getting f—-ed right now and it turns me the hell on…. Yeah I want to see you on Checkmates too.”
For specific sexual acts she performed, Gibson requested “tokens” from viewers. Each 100 tokens is approximately worth $5.
