Jonathan Turley, a legal expert and analyst with Fox News, shared his belief that Republicans will not be able to impeach Homeland Security Secretary Alejandro Mayorkas.
Republicans have threatened to impeach Mayorkas for months amid a growing crisis at the southern border and repeated accusations of dereliction of duty.
On Sunday, House Republicans issued two articles of impeachment against the Homeland Security head. The first cited Mayorkas’ “willful and systemic refusal to comply with the law.”
The second article is for a “breach of the public trust,” citing how Mayorkas had repeatedly lied to Congress when he said the southern border was “secure,” that it was “no less secure than it was previously,” that the border was “closed” and that DHS has “operational control” of the border.
The second article also cites Mayorkas’ statements supporting a September 2021 false narrative that suggested Border Patrol agents were guilty of “whipping” illegal migrants while riding on horseback.
A federal investigation verified the accusations, which were amplified by Biden administration officials, were false.
Despite the allegations, legal expert Jonathan Turley does not believe the House will be able to impeach Mayorkas.
Turley disputed assertions made by Rep. Marjorie Taylor Greene, pointing out that the Constitution allows for impeachment for high crimes, misdemeanors, treason, and bribery not for incompetence or dereliction of duty.
Turley stated:
The fact is, impeachment is not for being a bad cabinet member or even being a bad person. It is a very narrow standard. The framers rejected terms like maladministration to make sure that we confine this.
And it’s important to remember that we’ve only impeached one cabinet member in history and that was viewed as a fairly abusive use of impeachment, It was an impeachment after that person left office.
But past congresses have recognized that there is a danger to this. Once you cross the Rubicon and start to remove cabinet members because they are not doing a good job. And Mayorkas is clearly not doing a good job.
Putting the blame at President Biden’s feet, Turley continued:
But, it’s the job that President Biden apparently likes. He’s complimented Mayorkas, he’s carrying out Joe Biden’s policies. And those policies have brought us to where we are today, which is a national security crisis.
And I agree entirely with Republicans on all those points. But I don’t agree is the means being used here.
Mayorkas is someone who is carrying out precisely what the president has laid out as policies. The president has repeatedly said that he likes what Mayorkas is doing or not doing. Now, most Americans do not. But the president himself sets these policies and that’s what elections are all about.
The crisis at the southern border has become the No. 1 area of concern for most American citizens, with the latest polls showing that almost 65% of American voters believe the president must do more to secure the border.
The standoff between the Biden administration and Texas over the state setting up various “deterrents” to mitigate the flow of illegal immigrants into the state has stoked an already volatile situation.
Twenty-five Republican governors signed a petition opposing Biden and Mayorkas’ border policies and vowed to stand with Texas.
Also adding fuel to the fire was a recently released report that in December, a record 322,000+ illegals poured across the border.
Former Fox News host Tucker Carlson recently stated that according to a Yale University report, the immigrant population exceeds 22,000,000.
