On Friday, the Trump campaign joined with the Republican National Convention (RNC) to file a joint lawsuit against the Nevada Secretary of State, after they allowed mail-in ballots to be counted after election day.
Nevada’s Assembly Bill 321, a piece of legislation passed in 2021, allows mail-in ballots that are received up to four days after the election to be counted. AB321’s passage also ensured that every resident of Nevada would be given a mail-in ballot, according to the Secretary of State’s office.
Now, the Trump campaign and the RNC have announced their intention to challenge the deadline in a press release, arguing it “undermines the integrity of our elections and unlawfully extends the election past the federal Election Day mandated by Congress.”
“A victory in Nevada will have major ramifications for future elections in Nevada and across the country,” it added.
“Nevada’s ballot receipt deadline clearly violates federal law and undermines election integrity in the state,” said RNC Chairman Michael Whatley. “Ballots received days after Election Day should not be counted — the RNC and our partners are suing to secure an honest election, support Nevada voters, and oppose unlawful schemes.”
The text of AB321 states that the law will “require a mail ballot that is mailed to the county or city clerk to be received by 5 p.m. on the fourth day following an election,” and came following the contentious 2020 election, in which Biden beat Trump in the state by less than 34,000 votes.
Secretary of State Francisco Aguilar (D) told the Daily Caller in a statement that “Nevada runs some of the most secure, transparent, and accessible elections in the country.”
“The key for that accessibility is allowing working Nevadans to vote using the method that works best for them, including voting by mail,” said Aguilar. “Our office will not comment on ongoing litigation, but I hope the RNC is putting as much time and energy into educating voters on how to participate in elections as they put into suing the state of Nevada.”
Trump is currently leading Biden in the RealClearPolitics average for Nevada by 4.5 points.
“The RNC is now active in 83 fair election lawsuits in 25 states. Our unprecedented operation is fighting for voter confidence and honest elections across the country,” The RNC’s Press release read. According to the Daily Caller, in March alone, the GOP challenged Michigan Secretary of State Jocelyn Benson (D) on two separate occasions.
“Election integrity starts with clean voter rolls, and that’s why the National Voter Registration Act requires state officials to keep their rolls accurate and up-to-date. Jocelyn Benson has failed to follow the NVRA, leaving Michigan with inflated and inaccurate voter rolls ahead of the 2024 election. The RNC is filing this key lawsuit because Michigan voters deserve clean voter rolls and confidence in their elections,” Whatley said in a press release relating to one case, regarding voter registration rolls.
“Michigan’s State Constitution is very clear: election officials have to verify the identity of voters casting absentee ballots,” Whatley said in a press release regarding the second suit, which related to absentee ballots. “Jocelyn Benson is yet again working to undermine election integrity by secretly instructing officials to disregard and circumvent these clear requirements. The RNC is suing Benson because Michiganders deserve election integrity, not underhanded Democrat schemes.”
